September 10th, 2013. The National People’s Congress (NPC) recently issued the second version of the draft Amendment to the PRC Law on the Protection of Consumers’ Rights and Interests for public comment. The deadline for submitting comments is 5 October 2013. In Article 9 of the Amendment, a system for consumers to demand the return of goods without any reason is established on the basis of the existing law which enables consumers to demand the return of goods if there is any quality problem, and under Article 25 of the Amendment, punitive damages will be awarded against operators which commit fraudulent acts. As soon as the new law will be approved, we will post a more detailed analysis.
